Lo ammetto: nemmeno io pensavo che, nel tempo intercorrente tra la presentazione del ricorso della Juventus al Collegio di Garanzia del CONI e il pronunciamento dell'ultimo organo della giustizia sportiva in merito al caso plusvalenze, potesse succedere altro di interessante. Ero certo che, almeno fino a maggio, ci si sarebbe occupati quasi esclusivamente di calcio giocato, pur dovendo sopportare le scientifiche fughe di notizie, fatte trapelare ad arte dalla procura dell'odiatore Santoriello, prima di ogni match importante,
Evidentemente dovevo aver sottovalutato, e di parecchio, la vena artistica di chi tira le fila della procura federale, nonché l'abilità della carta stampata di seguire pedissequamente la direzione imposta, dato che, la notizia uscita ieri, come un potente fulmine capace di squarciare il cielo sereno, appare di portata probabilmente decisiva per il futuro dell'inchiesta.
Perché se i "cari" giornali dai colori discutibili o le trasmissioni sportive di ogni parte dello stivale, ci hanno raccontato per mesi qualsiasi sfaccettatura delle intercettazioni che riguardavano i dirigenti della Juventus, persino quelle di puro gossip, poco (pochissimo) hanno fatto per illustrare i punti della memoria difensiva bianconera inviata al CONI (molti giornali non hanno nemmeno riportato la notizia) e addirittura nulla su un aspetto ancora più importante, come il ricorso al TAR presentato dalla società piemontese per la mancata consegna di alcuni atti processuali.

Se ci trovassimo in un film americano o in un romanzo giallo, questo potrebbe rappresentare il classico colpo di scena, in grado di far prendere una direzione completamente diversa a tutta la storia. La procura federale, guidata dall'esimio dott. Giuseppe Chiné (del quale parleremo nel dettaglio tra poco), ha infatti negato fino a ieri ai legali della Juventus l'accesso ad alcuni atti del provvedimento sportivo, nello specifico la corrispondenza avvenuta tra la procura stessa e la COVISOC (la commissione di vigilanza sulle società professionistiche istituita dalla FIGC) nell'aprile scorso.
Nel carteggio, l'organo di vigilanza chiedeva alcuni chiarimenti interpretativi sulle operazioni di mercato della Juventus, cosa che, secondo gli avvocati della Signora, retrodaterebbe proprio ad aprile il momento in cui la procura federale è venuta per la prima volta a conoscenza dei nuovi fatti sull'inchiesta plusvalenze, facendo sostanzialmente scadere già a luglio i termini per la riapertura del processo.
L'ordinanza del TAR del Lazio in relazione al ricorso bianconero, ha stabilito non solo le ragioni della Juventus nel voler accedere a tutti gli atti ritenuti utili alla propria difesa, ma anche bacchettato piuttosto sonoramente Chiné e l'intera FIGC, rea di aver violato uno dei principi cardini della difesa. Detto in altre parole, va bene l'autonomia della giustizia sportiva, ma la stessa, checché ne dica Torsello, non deve mai dimenticarsi di appartenere ad un eco-sistema giuridico molto più ampio.
Entro sette giorni quindi conosceremo il contenuto di queste scritture e il loro grado di rilevanza all'interno del processo, scoprendo se dietro al rifiuto di Chiné di consegnare le stesse ai legali della controparte esista buona fede, vista la loro reale scarsa importanza ai fini del dibattimento (ma allora perché non consegnarle?), o, come pare sempre più probabile, un vero e proprio disegno, che se provato non stenterei a definire "criminale".

Se le carte dessero torto alla procura federale, le cose si metterebbero molto male per Chiné e per l'intera FIGC, che verrebbero probabilmente assaliti dalla Juventus, o dai singoli azionisti, con richieste di risarcimento danni milionarie. Qualora si dimostrasse che i termini per la riapertura del processo sportivo fossero scaduti, ma che la cosa sia stata scientemente occultata, ci troveremmo di fronte ad uno scandalo senza precedenti, che richiederebbe le dimissioni immediate di tutti i membri, inquirenti e giudicanti, dell'intero sistema della giustizia sportiva, nonché del presidente federale, Gabriele Gravina.
Significherebbe aver volutamente portato avanti un processo con la frode, con il solo scopo, a questo punto mi pare evidente, di danneggiare una società poco amata. La fine del calcio. Non ci rimane che attendere fiduciosi il trascorrere di questa settimana, ma intanto, come promesso, è bene rinfrescare la memoria su chi sia in realtà il procuratore federale Giuseppe Chiné, non certo una persona dal passato totalmente candido, come il ruolo che ricopre obbligherebbe.
Sono infatti ben due i poco lusinghieri esposti piovuti sul suo simpatico capo negli ultimi tempi: il primo risale al 2021, nell'interrogazione parlamentare portata avanti da alcuni senatori del Movimento Cinque Stelle, nel periodo in cui Chiné ha ricoperto il ruolo di capo di gabinetto del Ministero delle Finanze, omettendo tuttavia di citare nel curriculum la sua carica da procuratore federale della FIGC, per evitare possibili rilievi sul conflitto di interessi.

Il secondo invece, vede il nostro eroe accusato di violare il diritto di riservatezza da un tesserato dell'associazione allenatori, Daniele Sarappo. La posizione di quest'ultimo era stata archiviata dalla procura federale dopo un'indagine avviata sull'esposto della calciatrice Priscilla Del Prete, ma il diretto interessato non ha mai potuto leggere il documento con le motivazioni, negato da Chiné, che tuttavia l'aveva inviato come favore al presidente dell'associazione allenatori, Renzo Ulivieri, nel frattempo diventato allenatore della Del Prete.
Tutto questo, sempre senza dimenticare il suo ruolo da pubblico ministero presso il Tribunale di Latina nel periodo in cui scoppiò il caso dei passaporti falsi. Perché indovinate da quale motorizzazione venne rubata la patente di Recoba, evidentemente contraffatta? Proprio da quella di Latina, ma questa, of course, è solo l'ennesima coincidenza.

The federal prosecutor's office, headed by the exalted Dr. Giuseppe Chiné (of whom we will speak in detail shortly), has in fact denied until yesterday to the lawyers of Juventus access to some acts of the sporting measure, specifically the correspondence that took place between the prosecutor's office itself and the COVISOC (the supervisory commission on professional clubs established by the FIGC) last April.

If the papers proved the federal prosecutor wrong, things would look very bad for Chiné and the entire FIGC, who would probably be assailed by Juventus, or individual shareholders, with claims for millions in damages. Should it be proven that the terms for the reopening of the sports trial had expired, but that the matter had been knowingly concealed, we would be faced with an unprecedented scandal, which would require the immediate resignation of all members, investigating and judging, of the entire sports justice system, as well as the federal president, Gabriele Gravina.
It would be tantamount to having deliberately carried out a fraudulent process, with the sole purpose, at this point it seems obvious to me, of damaging an unloved club. The end of football. The second sees our hero accused of violating the right to privacy by a member of the coaches' association, Daniele Sarappo. The latter's position had been archived by the federal prosecutor's office after an investigation into the complaint by the footballer Priscilla Del Prete, but the person concerned was never allowed to read the document with the reasons, denied by Chiné, who had nevertheless sent it as a favour to the president of the coaches' association, Renzo Ulivieri, who had meanwhile become coach of Del Prete.
