On July the 14th, 2017; A Dallas man named as Brandon Gordy, was accused of fatally beating his girlfriend's 4-year-old son causing his death. According to officials, Gordy had been involved with Child Protective Services before the boy's death. CPS already had an open case on Gordy related to the physical abuse of Darwin's 3-year-old brother.

Gordy told investigators he was at home watching 4-year-old Darwin Delgado and his siblings while Rosa Angon Diaz, his common law wife, was at work. A doctor in the Dallas County medical examiner's office told police that Darwin Delgado had a several injuries which includeda fractured collarbone, a bruised scalp, brain swelling, cut lips, trauma in the rectum and small tears around it. According to the medical examiner's office, Darwin died from a laceration in his liver and extensive internal bleeding, . A doctor advised police that Darwin's injury could have occurred only from blunt force trauma. According to the arrest warrant affidavit, Brandon Gordy was the only adult in the family's apartment when Darwin collapsed. Gordy denied doing any harm to Darwin.
Gordy stated to the police that he had put soap in a washcloth for Darwin and left him in the tub. He then he went to check on his 6-month-old daughter. He also stated that he had heard a loud thump minutes later, ran to the bathroom and found Darwin partially submerged in the bathwater with one arm hanging from the side of the tub. He told the police that he held Darwin's head and the boy had said to him, "I'm OK, I'm OK, I'm OK." Darwin became unresponsive unresponsive and vomit and feces were coming out of his body. Gordy said that he called 911 and banged on a neighbor's door to ask for a ride to the hospital. But Gordy's 4-year-old son told police that he heard Gordy threaten to kick Darwin's -------Darwin's 3-year-old brother told an interviewer at the Dallas Children's Advocacy Center that he saw Gordy slap Darwin in the mouth. Police said Gordy became belligerent when he was accused of hurting Darwin and contradicted the children's stories.
According to court records, Gordy was convicted in 2016 on a marijuana possession charge out of Arlington, Texas.
The Office of Child Safety, which is independent from CPS, reviewed contacts with the family to determine whether the agency staff followed protocol,. a CPS spokeswoman Marissa Gonzales, declined to elaborate on CPS' involvement with Darwin's family on the basis of confidentiality. Darwin's siblings , the 4-year-old and 3-year-old boys and a 6-month-old girl, were been removed from the apartment and placed in CPS custody.
Gordy was held on an assault family violence charge for allegedly abusing his common law wife and for murder in the death of Darwin Delgado . His bond was set at over $1 million.
