Oregon Judge Awards $1.3 M to Foster Care Victum of Child Sex Abuse - K.U's Story

Oregon officials recently settled a lawsuit over the state placing a 4 year old girl, K.U.. in a Gresham foster home with a self-described sex addict who allegedly sexually abused her. Wallis identified himself as a sex addict during the state’s screening Process. Caseworkers either knew or should have known that Wallis looked at child pornography online, according to court documents. Oregon’s child welfare agency agreed to pay a settlement of $1.3 million.

The law suit claimed that Wallis abused K.U. in summer of 2014, and that the state neglected K.U.s safety by placing her in his home. Wallis was charged with rape and six counts of first-degree sex abuse in June 2012, but he was acquitted of all charges. The charges came about after Wallis's wife discovered possible indicators of abuse and took K.U. to speak with child abuse investigators. The lawsuit claimed that the state had certified Wallis as a foster care provider despite obvious warning signs.

Wallis told DHS during the home study for foster parent certification that he self-described as a sex addict. According to Josh Lamborn, K.U’s attorney, Wallis was diagnosed with obsessive compulsive disorder and obsessions and compulsions with pornography and strip clubs.

"This case was one of the most egregious I've ever seen for certifying a foster parent who has these glaring issues. These red flags were just so obvious and the (foster home) certifier did really nothing to independently investigate these issues," said the girl's lawyer, Josh Lamborn.

The state, according to the court documents, took custody of K.U. when she was vulnerable and needed a safe, stable home: her mother and step-father "neglected her and exposed her to a high-risk environment involving drugs, prostitution and gang activity,". Instead, the girl's lawyers stated, the state neglected K.U's safety when the caseworkers certified Wallis to care for children and then placed K.U. with them, despite obvious warning signs Wallis was a danger to children.

"During the home study for foster parent certification, Wallis disclosed to DHS that he self-described as a sex addict, he was diagnosed with obsessive compulsive disorder and had obsessions and compulsions with pornography and strip clubs," Lamborn wrote in the lawsuit. The state "nonetheless certified Wallis as a foster care provider for children in state custody."

Wallis went on to abuse K.U. over two months in the summer of 2014, according to the lawsuit. The suit did not address the fact that Wallis was acquitted of all criminal charges. The possibility that K.U. had been abused came to light when K.U. saw Wallis's wife's lubricant gel and stated that it was her special lotion. Wallis's wife took K.U. to see trained child abuse investigators. K.U. described during interviews how her foster father would do "secrets" with her while the foster mother was swimming or babysitting other children. The "secrets" included genital to genital contact. The state then removed the K.U. and her 1-year-old sister from the Wallis home.

The Multnomah County District Attorney's Office charged Wallis with rape and six counts of first-degree sex abuse, after K.U. made detailed disclosures to child abuse investigators. The Circuit Court Judge Jerry Hodson acquitted Wallis on all counts in June 2015. Wallis also is not required to pay any damages as part of the settlement.

The state's agreement to pay more than $1 million into a trust for K.U. is one of the latest in a series of huge settlements charging that the state workers have failed to prevent children in their care from both sexual and physical abuse.
